The FDA has issued a wide-ranging recall of certain Philips CPAP and BiPAP machines because the polyester-based polyurethane sound abatement foam may breakdown and potentially enter the devices’ air pathway. If this occurs, black debris from the foam or a certain chemical released into the device’s air pathway may be inhaled or swallowed by the person using the device. Philips has received complaints about the use of these machines regarding headache, dizziness, asthma, an inflammatory response, etc. It is possible that some long-term, permanent and life-threatening health complications, including cancer, could be related to the use of certain Philips CPAP and BiPAP machines.
Now, you might be asking yourself why is Gary Poole, a motorcycle and auto accident attorney, writing a blog about Philips CPAP and Philips BiPAP. The reason is that I was recently contacted by an individual in North Carolina regarding whether I knew of an attorney who handled claims against Philips for side effects that he had been experiencing as a result of using one of the Philips CPAP machines that had been recalled. He knew I would not handle the case, but because I am involved in cases involving personal injury, he thought I might know of an attorney who could help him, and I did. I connected him with an attorney who is very experienced with claims related to medical devices and with class action lawsuits. As it turns out, this attorney is already very involved with the Philips class action litigation.
As you should know from reading my blogs or looking at my website, I restrict my practice to representing individuals who have been injured in motorcycle accidents, car accidents, etc. But, I will often get calls from individuals who have been injured in some other way. It could be as a result of a medical device, medical malpractice, an on-the-job accident, a fall, etc. That person could be a former client or maybe they found me through an internet search. When I get those type of calls, I try to see if I can get the name or names of lawyers that could possibly help them with their specific type of claim..
If you know of someone that would like to talk to a lawyer about a possible claim related to a Philips CPAP or Philips BiPAP machine give me a call and I can provide the name of a lawyer who can talk with them about their claim.
